Terms of Service

By creating an account or accessing HourIQ (the "Service"), you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service

HourIQ is a productivity tool designed to assist freelancers with timezone management and time tracking.

  • No Legal/Financial Advice: The Service generates reports based on data you input. We are not an accounting firm or legal advisor. You are solely responsible for ensuring your invoices and tax filings are accurate and comply with local laws.
  • Availability: We strive for 99.9% uptime but cannot guarantee the Service will be uninterrupted or error-free.

2. Accounts

When you create an account with us, you represent that the information you provide is accurate, complete, and current. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You are responsible for safeguarding the password that you use to access the Service.

3. Subscriptions and Billing

  • Pro Plan: The Pro plan is billed in advance on a recurring and periodic basis (monthly or annually).
  • Payments: All payments are processed by third-party gateways. We do not store financial credentials.
  • Cancellation: You may cancel your subscription at any time. Your access to Pro features will continue until the end of your current billing period.
  • Refunds: Refunds are granted at the sole discretion of Nomad World. Generally, we do not offer refunds for partial months of service.

4. Return Policy and Right of Withdrawal

As HourIQ is a digital subscription service, the following return and refund policies apply:

  • Digital Service Nature: HourIQ provides immediate access to digital services upon subscription. Unlike physical products, digital subscriptions cannot be "returned" in the traditional sense.
  • Right of Withdrawal: If you are a consumer in the European Economic Area (EEA), you have the right to withdraw from your subscription within 14 days of purchase, unless you have explicitly consented to immediate access and acknowledged that you will lose your right of withdrawal upon such consent.
  • Refund Eligibility:
    • If you cancel within the withdrawal period and have not used the Service extensively, you may be eligible for a full refund.
    • After the withdrawal period, refunds are granted at our sole discretion and typically only in cases of technical issues preventing service access or billing errors.
    • No refunds are provided for partial billing periods after cancellation. Your subscription will remain active until the end of your current billing cycle.
  • Refund Process: To request a refund, please contact us at support@nomadworld.app with your account details and reason for the refund request. We will review your request and respond within 14 business days.
  • Chargebacks: If you dispute a charge through your payment provider without first contacting us, we reserve the right to suspend or terminate your account pending resolution of the dispute.

5. Intellectual Property

  • Your Content: You retain all rights to the data, text, and files you upload to the Service ("User Content"). By uploading content, you grant us a license to host, store, and display this content solely for the purpose of providing the Service to you.
  • Our IP: The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Nomad World.

6. Acceptable Use

You agree not to use the Service:

  • In any way that violates any applicable national or international law.
  • To transmit viruses or malicious code.
  • To attempt to gain unauthorized access to our servers or other user accounts.

7. Limitation of Liability

READ CAREFULLY: In no event shall Nomad World, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any errors or inaccuracies of content;
  • Any timezone calculation errors leading to missed meetings or contract disputes. You are responsible for verifying your own schedule.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
